Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Ofero, a B2B digital signage and marketing content platform operated by Advermint (CVR 43665499, VAT DK43665499), Asser Rigs Vej 8, st. tv., 5000 Odense C, Denmark (“Ofero”, “we”, “us”). By creating an account or using the service, you agree to these Terms.
1. The service
Ofero is a B2B digital signage and marketing content platform that helps businesses create, schedule, display, publish, and export branded content such as digital menus, promotions, messages, branded visuals, and public menu pages for in-store screens and online use. Image export is part of the product; video/rendering tools may be available where enabled or included in the customer’s plan.
2. Eligibility and business use
Ofero is for business use only. By using the service you confirm that you are at least 18 years old and that you are using Ofero on behalf of, and for the purposes of, a business, organization, or professional activity. Ofero is not directed to consumers or children.
3. Acceptable use
Your use of Ofero is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. You must not use the service in any way that violates that policy.
4. Your content and responsibilities
You retain ownership of the content you upload, create, or display through Ofero. You are responsible for that content and grant us the limited rights needed to host, process, and display it so we can provide the service. You represent and warrant that:
- You hold all rights and the legal basis needed for the content you upload, display, publish, or export (including images, text, logos, and any personal data within it).
- Your content and its display comply with all laws and regulations applicable to you — including those covering advertising, labeling, food and menu information, pricing, alcohol and tobacco, health claims, public display, and consumer protection.
- Information you present to the public (such as prices and product details) is accurate and kept up to date by you.
5. Fees and billing
Ofero is offered as a software subscription. Fees apply for paid plans, where billing is enabled, or where an order or checkout exists for your account. Unless stated otherwise, paid subscriptions renew monthly until cancelled.
- You can cancel at any time. Cancellation takes effect at the end of the current billing period, and you keep access until then. You can cancel in-product where available and/or by contacting support.
- Fees are non-refundable except where required by mandatory law or expressly agreed in writing.
- Taxes may apply depending on your location. We may change plans and pricing on reasonable notice; changes do not affect a billing period already paid for.

6. AI and video features
Ofero includes AI-assisted and video/rendering features.
- When you use AI-assisted features (such as AI headline generation), the text you submit is sent to the configured AI provider to generate a result. AI output may be imperfect — review it before publishing.
- Video and rendering tools may be available depending on your plan or configuration.
7. Suspension and termination
We may suspend or terminate your access — in whole or in part — where reasonably necessary, including for:
- Violations of these Terms or the Acceptable Use Policy.
- Illegal, infringing, harmful, deceptive, abusive, or otherwise prohibited content.
- Security abuse, account compromise, scraping, malware, spam, or attempts to circumvent technical or usage limits.
- Legal or compliance requirements, or lawful requests.
- Non-payment, once billing is active for your account.
- Conduct that risks harm to other users, third parties, or the service.
Where feasible we will give notice, but we may act immediately in urgent legal, security, or abuse situations. On termination, your data is handled in line with the retention and deletion provisions of our Privacy Policy.
8. Availability, warranties, and support
We provide the service on a best-effort basis and aim to keep it available and to respond to support requests within a reasonable time. We do not commit to any specific uptime percentage or service-level agreement (SLA). To the maximum extent permitted by law, the service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement.
9. Limitation of liability
To the maximum extent permitted by applicable law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or relating to the service. Our total aggregate liability arising out of or relating to these Terms is limited to the amounts you paid to us for the service in the 12 months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited or excluded under mandatory law.
10. Changes to these Terms
We may update these Terms from time to time. Where changes are material, we will take reasonable steps to inform you. Your continued use of the service after an update takes effect constitutes acceptance of the updated Terms.
11. Governing law
These Terms are governed by the laws of Denmark, without regard to its conflict-of-laws rules, and the courts of Denmark have jurisdiction, to the extent permitted by applicable law. Ofero is operated by Advermint.
